The following terms of use (the "Terms") constitute a binding agreement between Routescan and the person, persons, or entity ("You" or "Your") accessing and/or using the Explorer. The Explorer includes code licensed under third-party license agreements, including open source made available or provided with the software. By accessing and/or using the Explorer, You have read, understood, and accepted all of the following Terms and agree to be legally bound by these Terms, in their most recent version; You further represent and warrant that: You have the right, power and authority to enter into these Terms on behalf of such corporation, governmental organization or other legal entity and to legally bind it to these Terms.Your access and/or use of the Product is contingent upon Your acceptance of these Terms.Routescan may amend these Terms at any time. Amendments will be effective 24 (twentyfour) hours after the modified terms and conditions have been posted on the Website, except for amendments that relate to new features or made for legal reasons, which will become effective immediately. If You do not agree to such modified terms, You should discontinue Your use of the Product.
2. PRODUCT
The Product is a software that allows You to access data about blocks, transactions, addresses, network statistics and mempools related to different blockchains. By accessing the Website, You expressly relieve and release Routescan from any and all liability and/or loss arising from your use of the Product.
3. PRIMARY OBLIGATIONS AND WARRANTIES
By using the Product, You warrant that:- You will only use the Product for Permitted Use.
- Except for the open source contents of the Website, You will not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works in whole or in part with respect to the Product.
- You will not do anything to harm Routescan's reputation including Routescan's Products or Services. Including any representations about the Product provided.
- You will not use the Product to publish, disseminate, or otherwise make available any illegal content of any kind, including but not limited to content that is sexual, terroristic, racist, defamatory, harassing, abusive, or otherwise objectionable or unlawful.
- Any illegal content encountered through the use of the Product must be reported immediately using the specific form provided on the Website. Routescan will, to the possible extent, take appropriate action upon receiving such reports.
The Product is provided "as is," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non infringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.Any use of the Product in court proceedings in any jurisdiction, whether as evidence or otherwise, must be priorly authorized in writing by Routescan. Unauthorized use of the Product in legal proceedings is strictly prohibited and may result in termination of your access to the Product and further legal action. 4. COMPLIANCE AND ACCOUNT REGISTRATION
You must only access and use the Product for a bona fide and Lawful business use.You shall in connection with the use of the Product comply with all legislation, regulations, and other rules having equivalent force which are applicable to that party, including the Privacy Laws and all other Laws, rules and regulations that relate to the privacy, protection, use or disclosure of Personal Information, and any subordinate or associated regulations.You must comply with all Privacy Laws in relation to Personal Information.By accessing the Website You have the chance to create an account (with Routescan) to access specific services ("Account"). When you create an Account, you agree to:- (a) provide accurate and truthful information;
- (b) maintain and promptly update your Account information;
- (c) maintain the security of your Account by protecting your credentials and restricting access to your computer and your Account;
- (d) promptly notify us if you discover or otherwise suspect any security breaches related to your Account; and
- (e) take responsibility for all activities that occur under your Account and accept all risks of any authorized or unauthorized access to your Account, to the maximum extent permitted by law.
5. SERVICE LIMITATIONS AND MODIFICATIONS
Routescan will make reasonable efforts to keep the Product operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions.To the extent permissible under applicable law, Routescan reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the Product, with or without notice, without liability to You, for any interruption, modification, or discontinuation of the Services or any function or feature thereof.
6. INTELLECTUAL PROPERTY RIGHTS
You acknowledge and agree that, except for the open source contents, the Product is the property of Routescan or its licensors. Subject to Your compliance with these Terms, Routescan grants You a license access and/or use of the Product. The right to access and/or use the Product is a non-exclusive, non-transferable, revocable, limited license, and it is subject to the limitations and obligations contained herein. Nothing in these Terms gives You any license (other than as set out in this section), right, title, or ownership of, in, or to any of the Product.You acknowledge and agree that Routescan retains all rights, title, and interest in and to all copyrights, trademarks, trade secrets, patents, and any other proprietary rights in the Product, the software and application programming interfaces (APIs) comprising the Product, and all content therein. You acknowledge and agree that Routescan, its trademark, service mark, logo and graphics are the registered trademarks or trademarks of Routescan.All other trademarks, registered trademarks, product names and company names or logos mentioned through our Services are the property of their respective owners. Reference to any products, services, processes or other information, by name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by Routescan.Routescan may use other companies' name, logo, and related trademarks in any of Routescan's publicity or marketing materials (whether in printed or electronic form) for the purpose of highlighting that they use the Routescan Product and Services and alongside any testimonials that they have agreed to give. These companies grant Routescan such rights as are necessary to use its name, logo, related trademarks and testimonials for the purpose of this clause. If you provide any feedback, suggestions, or ideas regarding the Services ("Feedback"), you hereby assign to Routescan all rights, title, and interest in and to such Feedback. Routescan may use the Feedback for any purpose without any obligation to you.
7. TERMINATION
Routescan may terminate these Terms or suspend Your use to the product at any time, including, without limitation, in the event of Your alleged or actual misuse of the Product or breach of these Terms.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, under no circumstances will Routescan, its affiliates, officers, directors, employees, agents, licensors, or suppliers be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages (including loss of profits, data, goodwill, or business interruption) arising out of or in connection with your use of the Product, whether based in contract, tort (including negligence), or otherwise. This includes, but is not limited to, any financial or other loss resulting from your reliance on information provided through the Product or from interruptions, delays, errors, or omissions in the Service.The Product is provided "as is" and "as available," without any warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that you access and use the Product at your own risk.
9. RESTRICTIONS
By accessing and/or using the Product, you warrant that you will not use the Product in any manner that violates applicable laws, infringes the rights of any third party, or interferes with the proper functioning of the Product or the experience of other users. In particular, you agree not to:- (a) Use the Product in a way that degrades, overloads, damages, or impairs the performance of our systems or hinders other users' access;
- (b) Employ the Product to support or facilitate any unlawful activity, including but not limited to money-laundering, terrorist financing, fraud, or illegal gambling;
- (c) Access or extract data via automated tools, robots, spiders, crawlers, scrapers, or any other non-native interface not expressly authorized by us, except where such automation is limited to search-indexing activities for display on the open web;
- (d) Introduce or propagate any virus, worm, trojan, logic bomb, or other malicious or disruptive software through the Product;
- (e) Reproduce, publish, or otherwise distribute content, labels, name-tags, or data obtained via our APIs, CSV exports, or any affiliated websites, without our prior written consent;
- (f) Access or use another user's account or attempt to evade access controls, filtering mechanisms, or areas of the Service you are not authorized to reach;
- (g) Develop or operate third-party applications that interact with the Product without obtaining our prior written approval;
- (h) Provide false, misleading, or materially inaccurate information to or through the Product; or
- (i) Encourage or assist any third party in engaging in conduct that would, if performed by you, breach these Terms.
Users are strictly prohibited from accessing or using the Product if they are located in, under the control of, or a national or resident of any country designated by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) as sanctioned countries. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Routescan, its affiliates, officers, directors, employees, agents, licensors, and suppliers from any claims, liabilities, damages, losses, assessments, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:- (i) Your breach of these Terms, including any of the representations and warranties you make hereunder;
- (ii) Your use or misuse of the Product; or
- (iii) Any infringement or violation of laws or third-party rights arising from your activities in connection with the Product.
11. NO CLASS PROCEEDINGS
Any claims arising out of or related to these Terms may only be brought on an individual basis, and you expressly waive any right to participate in a class action, consolidated proceeding, or representative action against Routescan. You may only seek individualized relief, including monetary, injunctive, or declaratory remedies, and not relief on behalf of others.
12. USER GENERATED CONTENT AND THIRD-PARTY RIGHTS
You are solely responsible for any User-Generated Content you post, upload, share, or otherwise make available through the Service, and for any harm that may result from such content, regardless of its form. Routescan assumes no liability for the public display or any misuse of your User-Generated Content and reserves the right, at its discretion, to remove or refuse any content that appears to violate these Terms or our internal policies.You retain all moral rights you may have in your User-Generated Content, including rights of attribution and integrity. However, you agree to waive these rights against Routescan to the extent required to enable Routescan to exercise the rights granted in this Section. If any such waiver is not enforceable under applicable law, you further grant Routescan the minimum rights necessary to use your content without attribution and to make reasonable adaptations for the purposes of providing the Service.If you submit any material that you did not create or for which you do not hold the necessary rights, you represent and warrant that you are authorized to share that material and that you will comply with all applicable third-party licenses. By submitting such content, you grant Routescan and its successors the right to store, parse, display, and make incidental copies of your content as reasonably necessary to operate, maintain, and improve the Service.Other than as expressly stated in the Agreement, a person who is not a party to this Agreement may not enforce any of its terms.
13. ENTIRE AGREEMENT
These Terms constitute all the terms and conditions agreed upon between You and Routescan and supersede any prior agreements in relation to the subject matter of these Terms, whether written or oral.
14. SEVERABILITY AND WAIVER
Unless as otherwise stated in these Terms, should any provision of these Terms be held totally or partially invalid or unenforceable, such invalidity or unenforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of these Terms, and the application of that provision shall be enforced to the extent permitted by applicable laws.The failure of Routescan to exercise or enforce any of the rights or provisions of these Terms shall not be considered as a waiver of Routescan's rights to do so.
15. ASSIGNMENT
Routescan may assign these Terms and/or delegate any of its obligations hereunder, in whole or in part. You may not assign these Terms or any part of them, nor transfer or sub-license Your rights under these Terms to any third party.r provisions of these Terms shall not be considered as a waiver of Routescan's rights to do so.
16. NO PARTNERSHIP
Nothing contained in this Agreement shall be deemed or construed to create a principal and agent, partnership or joint venture relationship between You and Routescan.
17. FORCE MAJEURE
Routescan will not be deemed in default of these Terms to the extent that performance of its obligations is delayed or prevented by reason of any external force including, without limitation, war, insurrections, bank failures, telecommunications failure, Internet failure, strikes, fires, floods, earthquakes, labour disputes, epidemics, governmental regulations, freight embargoes, natural disaster, an act of government or any other cause beyond Routescan's reasonable control.
